Terms of Use
Draft. This document is a starting point and must be checked by a South African attorney before schools rely on it.
These terms apply to everyone who uses MarkTrack, a web service run by ("we", "us") that helps schools analyse learners' marks and produce subject performance reports. By creating an account you agree to them.
1. Accounts
- You must be a staff member of the school you join, and use your own email address. Keep your password private and do not share your account.
- A school is registered by a staff member authorised by the principal. That person becomes the school's first admin and accepts the Operator Agreement for the school.
- School admins decide who may join their school and what role each person has, and must remove staff who leave.
2. Learners' information
- The school is the responsible party for its learners' information under the Protection of Personal Information Act 4 of 2013 (POPIA). We are the school's operator: we process that information only on the school's behalf, as set out in the Operator Agreement.
- Upload only what your school allows you to and only what the service needs (learner names, classes and marks). Do not upload ID numbers, contact details, health or disciplinary information.
- Use reports and downloads only for school purposes and store downloaded files securely.
3. Trial, subscription and payment
- A new school gets a free trial of days. Nothing is charged automatically.
- After the trial the school may subscribe for 12 months at a time. We send an invoice on request; access is extended once payment is received.
- If a trial or subscription ends, the school's information stays available to view and download, but new marks cannot be added or changed until it is renewed.
- Prices may change for a new subscription period; we will tell the school's billing contact at least 30 days before.
4. Acceptable use
Do not try to access another school's or colleague's information, interfere with the service, or use it for anything unlawful.
5. The service
- We aim to keep the service available and secure but cannot promise it will never be interrupted. Calculations are provided as a tool; teachers remain responsible for checking marks and reports before submitting them.
- To the extent the law allows, our total liability to a school is limited to the subscription fees it paid in the 12 months before the claim. Nothing in these terms limits rights you have under the Consumer Protection Act where it applies.
6. Ending use
A school may stop using the service at any time. When it asks us, or 90 days after its access ends, we delete its information as described in the Privacy Policy. We may suspend an account that breaks these terms.
7. Changes and law
We may update these terms; the version number above changes and you will be asked to accept material changes. South African law applies.
